The Employment Rights Act 1996 (Itemised Pay Statement) (Amendment) Order 2018 is due to come into force on 6 April 2019.

The Order amends section 8(2) of the Employment Rights Act 1996 to add to the list of particulars which must be included in an itemised pay statement.

Where an employee’s pay varies by reference to the time worked, the Order will require the itemised pay statement to contain information regarding the number of hours worked by the employee. The information can either be given as an aggregate number of hours, or as separate figures for different types of work or different rates of pay.
